This is particularly important when undertaking Due Diligence to ensure you are aware of the compliance issues which would affect your property ownership or occupation. As part of a Building Survey or Acquisition Survey, it is important to understand the liabilities you would inherent. If you are assigning a standard fully repairing Lease this would usually involve an obligation to comply with statute, and even if your repairing obligations are limited it is likely that any Tenant would be responsible for ensuring compliance with all up to date Legislation. This could incur a substantial liability during initial occupation unless thoroughly investigated and any requirements are challenged with a Landlord.
Whether acting for the investor or Landlord it is similarly important to ensure you understand the obligations of your Tenants to ensure your property remains in a safe and compliant manner, that any insurance obligations are not compromised and that your Tenants comply with the contractual terms of the Lease.
